1. Prices
1.1 All prices are expressed in American Dollars (USD).
1.2 The prices, offers and details contained on our website and in our brochures are valid at the time of publication. Please note that prices, offers and details are subject to change without previous notice. Where this is the case, they will be updated on our website.
2.Contract
2.1 Bookings can be made by telephone, facsimile, e-mail or via our website.
2.2 The person making the booking must be at least 18 years old and possess the legal capacity and authority to make the booking and accepts these booking conditions on behalf of everyone in their party.
2.3 A booking is accepted and becomes definite only from the date Perú Journeys E.I.R.Ltda. has confirmed acceptance and issued a confirmation invoice. It is at this point that a binding contract between Perú Journeys E.I.R.Ltda. and the client comes into existence.
3. Payment
3.1 On booking you will need to pay a non-refundable deposit of 20% of the total amount (minimum USD 200,- or equivalent).
Exceptions:
a) If you book one of the Inca Trail programs you will need to pay a non-refundable deposit of 100% of the total amount.
b) If you book only international flights you will need to pay a non-refundable deposit of 100% of the total amount.
3.2 The remainder of the cost must be paid to Perú Journeys E.I.R.Ltda. no later than 30 days before departure.
3.3 If you book less than 30 days before departure, full payment must be made on booking.
3.4 If you do not pay the balance of your vacation cost by the due date of 30 days before departure, your booking will be terminated and you will lose your deposit.
3.5 Payment can either be made by transferring the total amount of the invoice to one of our bank accounts or money order. In case of a bank transfer or money order all wiring and transfer costs bears the client.
4. Surcharges
4.1 Before your booking is confirmed and a contract comes into force, we reserve the right to increase or decrease brochure prices or the prices issued on our website. You have the right to withdraw from the booking at this stage if you do not accept the price revision. The contract will exist when you have accepted or not objected to any price revision and we have issued a confirmation invoice.
4.2 We reserve the right to impose surcharges once you have booked but no surcharges will be imposed within 30 days of departure and any downward revision in the price will be refunded to you. Surcharges will only be imposed for variations in:
a) transport costs, including the cost of fuel.
b) dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports
c) the exchange rates applied to the booking.
If the surcharge results in an increase of more than 10% of the vacation cost, the client may cancel the booking within 7 days notification of the surcharge and obtain a full refund.
5. Changes and Cancellation by the Client
5.1 The client can cancel the booking any time.
5.1 Notification of cancellation must be made to Perú Journeys E.I.R.Ltda. in writing and will be effective upon receipt.
5.2 If you cancel your booking more than 30 days before departure we will not refund your deposit. If you cancel your booking for within 30 days of departure the following cancellation charges will be made:
- more than 30 days before departure: loss of deposit
- between 30 and 21 days before departure: 40% of the total amount
- between 20 and 14 days before departure: 60% of the total amount
- between 13 and 8 days before departure: 80% of the total amount
- 7 days or less before departure (or fail to join the holiday; no show): 100% of the total amount
These dates refer to the date we receive written notification of your cancellation. We strongly recommend you to take out insurance against irrecoverable cancellation costs.
5.3 If you cancel your booking more than 30 days before departure you may transfer your deposit to another trip in our current program (provided you are not already booked on it) on payment of a transfer fee of USD 75,- per person, subject to your notifying us in writing within two weeks of your cancellation, telling us which trip you wish to transfer to and paying the transfer fee. If the trip you transfer to is more expensive than the one you originally booked, a further deposit will also be payable. If you subsequently cancel the trip to which you have transferred, we will retain your full original deposit and transfer fee.
5.4 If you are prevented from travelling, you may transfer your booking to another person provided they meet all the requirements relating to that holiday. A transfer fee of USD 75,- will be payable, or USD 125,- if the transfer is less than 30 days before departure. Additional costs such as airline tickets, entrance fees and permit fees may also be payable. Should you transfer your booking to another person, you will both be jointly and severally liable for payment of the holiday price and other associated expenses.
5.5 If the client decides not to use portions of tours, whole trips or packages or chooses a different accommodation, meals or modes of transport, Perú Journeys E.I.R.Ltda. will pay no refund and additional costs bears the client.
6. Changes and Cancellation by Perú Journeys E.I.R.Ltda.
6.1 If an itinerary indicates a minimum number of travelers and there is an insufficient number of participants to run this holiday Perú Journeys E.I.R.Ltda. reserves the right to cancel the trip. In this case we shall inform you 30 days prior to departure and we will refund your deposit less incurred expenses.
6.2 On an active group holiday it is necessary that you abide by the authority of the tour leader, who represents the company. If the client commits any illegal act when on the holiday, doesn't meet all the requirements relating to that holiday, physical or otherwise, or if in the reasonable opinion of the tour leader your behavior is causing or likely to cause danger, distress or annoyance to others we may cancel your travel arrangements without any liability on our part.
7. Cancellation due to force majeure
If an alteration or cancellation has come about because of unavoidable, unusual and unforeseeable circumstances beyond our control or affected by reason of circumstances amounting to “force majeure” we will not compensate you for the inconvenience.
Circumstances amounting to "force majeure" include any event which we or the supplier of the service(s) in question could not even with all due care, foresee or forestall such as war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, weather, political conditions, flight cancellations, rescheduling of flights, mechanical breakdown, epidemics or health risks, border restrictions, sickness and all similar events.
We always will endeavor to inform you at the earliest opportunity about such changes.
8. Responsibility of Perú Journeys E.I.R.Ltda.
8.1 Perú Journeys E.I.R.Ltda. is responsible for providing all the services andfor the proper performance of our obligations under the contract irrespective of whether those obligations are provided directly by us, or by third party service providers engaged by us acting within the proper course of their employment.
8.2 Perú Journeys E.I.R.Ltda. is not responsible and accidents, sickness, losses or damage of personal effects or baggage, damages caused by the client, physical or mental impediments, delays or interferences with the tour, due to "force majeure" reasons.
9. Clients responsibility
9.1 Before you come on the holiday you must be covered by insurance, which must include adequate cover for baggage, medical expenses and the cost of repatriation, should you become too ill to continue, including helicopter rescue and air ambulance. If you join the holiday without adequate insurance you may not be allowed to continue on the holiday, with no right of refund.
9.2 If you have any complaint about the holiday, you must make it known at the earliest opportunity to the leader and/or our local representative, who will normally be able to take appropriate action. If you are not satisfied with their response and you feel your enjoyment of the holiday is likely to be significantly affected, you should notify our head office in Cusco and we will do our best to resolve the problem.
9.3 Please note that if you don't complain on the spot, Perú Journeys E.I.R.Ltda. will not consider your complaint and will not pay any compensation.
9.4 If you are affected by any condition, medical or otherwise, that might affect your or other people’s enjoyment of the holiday, you must advise us of this at the time of booking.
10. Flexibility Agreement
Your booking is accepted on the understanding that you realize the hazards involved in this kind of holiday, including injury, disease, loss or damage to property, inconvenience and discomfort. The whole philosophy of this type of travel is one which allows alternatives and a substantial degree of on-trip flexibility. The outline itineraries given for each holiday must therefore be taken as an indication of what each group should accomplish, and not as a contractual obligation on the part of Perú Journeys E.I.R.Ltda. Changes in itinerary may be caused by local political conditions, flight cancellations, mechanical breakdown, weather, border restrictions, sickness, or other unforeseeable circumstances. Pro rata refunds will be given for services not utilized wherever possible.
It is a fundamental condition of joining any of the holidays described in our brochures or on our website that you accept this flexibility, and acknowledge that delays and alterations and their results, such as inconvenience, discomfort, or disappointment, are possible: we will always endeavor to provide suitable alternative arrangements. If it is impossible to make alternative arrangements or if a passenger is unable, or does not choose for good reason, to complete an itinerary outlined for a holiday, Perú Journeys E.I.R.Ltda. is not under any obligation to supply alternative itineraries, excursions, accommodations, services or staff for the period when the client is not present with the group.
11. Passport-, Visa- and Health-Regulations
11.1 It is the responsibility of the client to comply Passport-, Visa-, and Health-regulations for himself and his party.All disadvantages, which arise from the disregard of these regulations, go to its loads, even if these regulations should be modified after the reservation. We cannot accept responsibility for any failure to comply resulting in any costs or fines being incurred and we advise you to check with your passport office or the consulate in question if you have any queries. Clients travelling overland to certain destinations may need to also pass through controls of other countries enroute so this should be allowed for with any passport/visa applications.
11.2 Any information or advice provided by Perú Journeys E.I.R.Ltda. on matters such as permits, visas, vaccinations, climate, clothing, baggage, special equipment, etc. is given in good faith but without responsibility on the part of Perú Journeys E.I.R.Ltda. It is your responsibility to check with your doctor at least two months prior to travel for the latest health requirements, recommendations for your destination and any costs.
12. Media use
Any likeness or image of you secured or taken on any of our holidays may be used by Perú Journeys E.I.R.Ltda.without charge in all media (whether now existing or in the future invented) for bona fide promotional or marketing purposes, including without limitation promotional materials of any kind, such as brochures, slides, video shows and on websites.
13. Agreement
When you offer to purchase a holiday from us you agree to accept all these conditions, and when we accept our booking we agree to carry out our obligations to you as defined in our brochure or on our website and their information provided to you.
